Can Foreign Buyers Purchase Real Estate in Big Sky, Montana?

Big Sky attracts buyers from around the world. With world-class skiing, incredible summer recreation, direct air access through Bozeman Yellowstone International Airport, and an expanding collection of resorts and private clubs, it’s no surprise that international buyers are increasingly interested in owning property here.

One question we hear from international buyers is simple:

Can a foreign buyer purchase real estate in Big Sky, Montana?

For most international buyers, the answer is yes. Foreign citizenship, by itself, generally does not prevent someone from purchasing residential real estate in Montana. However, international buyers should understand that there can be additional legal, tax, financing, and ownership considerations compared with a typical U.S. buyer.

Can a Non-U.S. Citizen Own Property in Big Sky?

Generally, yes.

International buyers can purchase many of the same types of Big Sky real estate as U.S. buyers, including:

  • Condominiums
  • Single-family homes
  • Vacation properties
  • Residential homesites
  • Properties within certain private club communities

Montana does have restrictions involving certain transactions with designated foreign adversaries, including some agricultural land, critical infrastructure, and certain real estate near military installations. Because laws can change and individual circumstances differ, international buyers should consult qualified legal counsel regarding their specific eligibility and proposed purchase.

For the typical international buyer looking at a condominium, vacation home, or residential property in Big Sky, foreign ownership can be entirely feasible.

Do You Need to Be a U.S. Resident to Buy Property?

No. Purchasing real estate and having U.S. immigration or residency status are separate matters.

You do not necessarily need to be a U.S. citizen or permanent resident to own property in Big Sky. Likewise, purchasing a home in Montana does not by itself provide U.S. residency, a visa, or immigration status.

International buyers who plan to spend significant amounts of time in Big Sky should separately discuss their travel and immigration requirements with an appropriate professional.

Can Foreign Buyers Get a Mortgage?

Potentially, although financing can look different for an international buyer.

Some U.S. lenders offer foreign-national mortgage programs, while others may require U.S. residency, established U.S. credit, or other documentation.

International buyers may encounter different requirements involving:

  • Down payments
  • Income and asset verification
  • International banking documentation
  • Credit history
  • Currency transfers
  • Cash reserves

Because Big Sky properties can involve substantial purchase prices, it can be helpful to speak with a lender experienced with foreign-national borrowers early in the search.

Cash purchases are also common in the Big Sky market.

How Should an International Buyer Hold Title?

This is an important question to address before closing.

Depending on the buyer’s circumstances, a property might be purchased individually or through an entity or other ownership structure. The appropriate approach can depend on nationality, tax residency, estate planning, intended use of the property, rental plans and other factors.

This is an area where we strongly recommend involving a U.S. attorney and tax professional with experience working with international real estate owners.

The goal isn’t simply to complete the purchase. It’s to establish an ownership structure that makes sense for how you intend to use and ultimately transfer or sell the property.

What About U.S. Taxes?

Owning U.S. real estate can create U.S. tax considerations for foreign owners.

These can become particularly important if you:

  • Rent the property
  • Generate income from the property
  • Sell the property
  • Transfer ownership
  • Hold the property as part of an estate

For example, rental income from U.S. real estate owned by a nonresident alien is subject to U.S. tax rules, although certain elections may allow rental income to be treated as effectively connected income and permit eligible expenses to be deducted.

International buyers should work with a CPA or tax attorney familiar with cross-border ownership rather than relying on general tax assumptions from their home country.

What Is FIRPTA?

Foreign owners should also understand the Foreign Investment in Real Property Tax Act, commonly known as FIRPTA.

FIRPTA becomes particularly relevant when a foreign person sells U.S. real estate. Under current federal rules, a buyer acquiring U.S. real property from a foreign seller is generally required to withhold a portion of the amount realized and remit it to the IRS, subject to certain exceptions and procedures.

Importantly, FIRPTA withholding is not necessarily the seller’s final tax liability. It is a withholding mechanism, and there are circumstances in which reduced withholding may be available.

This is another reason international owners should have qualified U.S. tax advice well before they decide to sell.

Can an International Owner Rent Their Big Sky Property?

Potentially, but the answer depends heavily on the specific property.

Short-term and long-term rental rules can vary based on location, homeowners association documents, deed restrictions, community rules, local regulations and other factors.

This is especially important in Big Sky because two seemingly similar properties can have very different rental opportunities.

If rental income is part of your purchasing strategy, we recommend identifying that goal at the beginning of the property search so rental eligibility can be evaluated property by property.

International owners should also seek professional tax advice regarding the treatment and reporting of U.S. rental income.

What About Big Sky’s Private Clubs?

International buyers can also explore real estate within Big Sky’s private club communities, including Spanish Peaks Mountain Club, Moonlight Basin and Yellowstone Club.

Club membership is separate from simply being eligible to own U.S. real estate. Each community has its own real estate offerings, membership structures, costs and procedures. Membership availability can also vary by property.

Understanding the relationship between the real estate and the club membership is an important part of evaluating these properties.

Buying From Outside the United States

You don’t necessarily have to spend weeks in Montana to complete a Big Sky real estate purchase.

Much of today’s transaction process can be handled remotely, including property searches, video tours, document review, electronic signatures and portions of the closing process.

That said, we strongly encourage buyers to experience Big Sky firsthand whenever possible.

Big Sky is a highly location-specific market. Ski access, views, sun exposure, proximity to amenities, club access and neighborhood character can vary considerably from one property to another.
